Has anyone considered that the cell phone companies might be violating the Federal Communications Act, an anti-trust statute or even an unfair debt collections practice statute, be refusing to activate phones with certain ESN's because they want to collect a debt or something like that. Really, if you are the legitimate owner of these phones you have every right to have them activated on your cell phone account upon request. The cell phone carrier's refusal to activate the phone is similar to the now discredited conduct of AT&T when it was a monopoly. AT&T would refuse to connnect various user owned phone equipment to its phone lines claiming all sorts of reasons. The FCC and the court decided that AT&T could not stop a customer from connecting to the phone lines any compatible piece of equipment and eventually developed standards for determining compatibility. This "bad ESN" business is a way to artificially depress the value of used cell phones in favor of increasing the value of new phones sold by the carriers. Does that make sense? Do you realize the under the Federal Communications Act cell phone carriers are prohibited from engaging in any unreasonable or unjust discrimination, practice, classification or regulation? Hey, how just is it for you not to be able to use your phone because of some prior owner didn't pay his bill? Since when are we liable for the debts of stangers like that?
Not only that but cell phone companies sell you a phone with a contract but if you try to use the phone with a nother carrier they can not activate the phone. Some can but most cant. So you might as wel just get a "FREE" phone instead of the high tech one that is useless if the carrier that sold it to you pisses you off and you decide to switch carriers.
